Qwikkie Terms and Conditions

1. Introduction

Welcome to Qwikkie a trademarked product of 1Techlink Limited. By accessing or using the Qwikkie mobile application (“App”) or website (“Site”), you agree to comply with and be bound by these Terms and Conditions (“Terms”).

These Terms govern your use of Qwikkie for logistics, delivery, vendor services, and affiliate programs within Nigeria. If you do not agree, please discontinue use of the App or Site.

Definitions

  • Platform – The Qwikkie mobile application and website.
  • User – Any individual or entity using Qwikkie to request goods, services, or deliveries.
  • Vendor – Any business (e.g., restaurants, stores, pharmacies, service providers) registered on Qwikkie to offer products or services.
  • Delivery Partner – Any logistics, courier, or haulage service provider partnered with Qwikkie for transportation of goods.
  • Affiliate – An individual or entity authorized to register Vendors or Delivery Partners and earn commissions on completed transactions.
Scope of Services
  • Qwikkie provides a digital marketplace connecting Users with Vendors and Delivery Partners.
  • Qwikkie does not own or control the businesses, goods, or delivery companies listed.
  • All services are provided within Nigeria, subject to the Federal Competition and Consumer Protection Act (FCCPA), Nigeria Data Protection Regulation (NDPR), and CBN e-payment guidelines.
Account Registration
  • Users, Vendors, Delivery Partners, and Affiliates must create an account to use the Platform.
  • Accurate and verifiable information must be provided during registration.
  • Users are responsible for safeguarding login details.
  • Any unauthorized use must be reported immediately to support@qwikkie.com.

User Responsibilities

  • Provide correct delivery addresses and contact details.

  • Ensure compliance with Nigerian law when placing orders (prohibited goods include narcotics, arms, explosives, counterfeit items, etc.).

  • Accept that delivery times may be affected by external factors (e.g., traffic, weather, security).

Vendor and Delivery Partner Responsibilities
  • Vendors must ensure goods/services are accurately described, safe, and compliant with Nigerian consumer laws.
  • Delivery Partners must ensure timely and professional deliveries.
  • Both must comply with applicable health, safety, tax, and licensing regulations.
Affiliate Program
  • Affiliates earn commissions for successful transactions from the vendors/Delivery Partners they register.
  • Commission structures are governed by the Affiliate Agreement.
  • Qwikkie may revise commission terms with prior notice.
Cancellations
  • Users may cancel an order before Vendor or Delivery Partner confirmation.
  • Once confirmed, cancellations may incur fees per the Vendor’s policy.
  • Excessive cancellations may result in account suspension.
Payments and Refunds
  • All payments are processed securely via the Platform in line with CBN regulations.
  • Refunds will follow FCCPC guidelines, typically within 7–14 working days, depending on Vendor approval and the nature of the service.
  • Refunds may be withheld if:
    • The service was delivered as agreed.
    • The User violated these Terms.
Intellectual Property
  • Qwikkie brand, logo, App, Site, and related IP belong to 1Techlink Limited.
  • Unauthorised copying, reverse-engineering, or commercial use is prohibited.
Limitation of Liability
  • Qwikkie is an intermediary platform and is not liable for:
    • Product quality or safety from Vendors.
    • Delivery delays, damages, or losses.
  • Qwikkie’s liability is limited to the transaction fee charged on the disputed order.
Termination of Accounts
  • Qwikkie may suspend or terminate accounts for fraud, illegal activity, or policy breaches.
  • Users may request closure of their account by contacting support@qwikkie.com.
Privacy & Data Protection
  • Qwikkie is committed to protecting Users’ personal data in line with the Nigeria Data Protection Regulation (NDPR) 2019.
  • By using the Platform, Users consent to the collection, storage, and processing of their personal data (such as name, email, phone number, payment details, and delivery address) strictly for service delivery.
  • Qwikkie will:
    • Use personal data only for legitimate business purposes (e.g., processing orders, payments, and customer support).
    • Not share personal data with third parties except Vendors, Delivery Partners, or regulatory authorities where legally required.
    • Implement reasonable technical and organizational measures to safeguard personal data against unauthorized access, loss, or misuse.
  • Users have the right to:
    • Request access to their personal data.
    • Request correction or deletion of their data.
    • Withdraw consent to data processing (which may affect the ability to use the Platform).
  • For any data protection concerns, Users may contact dpo@qwikkie.com (Data Protection Officer).
Dispute Resolution
  • Disputes should first be reported to Qwikkie support.
  • If unresolved, disputes will be referred to arbitration in Lagos, Nigeria, under the Arbitration and Conciliation Act, Cap A18 LFN 2004.
  • Arbitration awards are final and binding.

Amendments

Qwikkie may update these Terms from time to time. Users will be notified of significant changes via the App or Site. Continued use indicates acceptance.
